As I write this blog I can__™t help but think how boring this whole business of art business must be to so many of you. I mean, you read blogs by Peter and Gary and Mike, and they spin such wonderful stories of art history, clandestine meetings of great painterly women in museums, and the phenomenon of creative discovery in the ordinary classroom.
It makes me think of a program that was on PBS back in the 80__™s created by Steve Allen (creator of the original Tonight Show) that was the ultimate talk show called ___Meeting of the Minds.___ He would script a gathering at a round table with himself as host and people from history like Leonardo diVinci, William Blake and Niccolo Paganini. It was a program that encouraged viewers to become more familiar with the great thinkers of the past and to arouse their desires for more research and study. This is exactly what I believe Peter, Gary and Mike do. If I were to gather such a table, my guests would be the three of them. I can imagine quite vividly how animated the conversation would be!
But I digress. With the business of art being on the dry side, I thought it would be good to infuse a little something to make this a bit more interesting. So now that, hopefully, I__™ve drawn you in, I__™m going to switch to another form that will be helpful for those that have not yet gotten around to organizing their business. The following is a boiler plate "Letter of Agreement" that can be used in the event you find yourself being commissioned to do a painting, sculpture, or whatever. Remember, it__™s boiler plate and will require you to customize it to suit your needs.
If you have letter head, use it.
Jane Doe of Art Consulting Firm and Successful Painter have agreed that Mr. Painter will design and paint a large contemporary oil painting on linen measuring approximately 96___ x 60___. The price of the commission will be $10,000.00. The client will be provided a study for approval and sign off. Payments for this commission will be as follows:
Deposit of $5,000.00 due upon signing of this agreement and sign off of the study.
Balance of $5,000.00 plus shipping and transit insurance, upon delivery of the painting. Painting will be shipped unstretched to conserve on shipping costs.
The painting will commence upon receipt of the deposit and sign off of the study. The painting will be as similar as possible to the original study. Once the painting has commenced, a regular update will be provided to the client to allow for review. Ownership of the painting will pass to Art Consulting Firm upon receipt of final payment. Mr. Painter will retain all rights to the painting design.

Whenever possible, you should fill in dates so there are clear, defined benchmarks for all parties involved. The more specific you can be, the more comfortable it will be for everyone, including you. And at each of those benchmarks, get a sign off. The less surprises there are along the way, the better. Signatures speak volumes if any problems should occur at delivery.
